Sometimes, an employee asks for schedule changes, extra hours or even permission to work from home now and then. If you grant such requests, track them carefully.

Recent case: Katherine worked as a telemarketer. After getting into a vehement, profane argument with her supervisor, she was terminated for insubordination.

Katherine decided to get even in court. She sued for sex discrimination, claiming that a male co-worker had been allowed to work from home, got extra hours when he requested them and got modifications to his Saturday schedule when he asked.

However, she admitted she never asked to work from home or for a different schedule. When she did ask for additional work hours, she got them. The court dismissed the claim. (Garges v. The People?s Light and Theater, No. 09-2456, ED PA, 2012)

There's a lot to like about the Asus VivoBook S500CA-DS51t ($679.99 list). This Windows 8 entry-level ultrabook sports a trim design, responsive capacitive touch display, and reasonable price tag all contribute to an affordable Windows 8 experience. That said, its disappointing keyboard/ touchpad duo and so-so battery life hold it back.



Design and Features
With the exception of its slightly larger 15-inch display, the VivoBook S500CA looks nearly identical to its predecessor and our former Editors' Choice for entry-level touch-screen ultrabook, the Asus VivoBook S400CA-UH51. Its chassis measures 0.80 by 15.1 by 10.2 inches (HWD) and is decked out with a dark brushed metal lid and a matte silver keyboard deck. At 4.73 pounds, it's on the heavy side for ultrabooks, especially when compared to our current Editors' Choice for entry-level ultrabooks. the Acer Aspire M5-481PT-6644 (4.4 pounds) or the Toshiba Satellite U945-S4390 (3.85 pounds). Despite the VivoBook S500CA's more pronounced mass, its sleek profile nevertheless allows it to easily slip into a backpack or laptop bag.

The 15-inch LED display has a maximum resolution of 1,366 by 768, which is good enough to support 720p videos. Although it can't deliver HD content in 1080p like the pricier Asus Zenbook Prime Touch UX31A-BH15T , the VivoBook S500CA's glossy screen deserves props for its bright picture and vibrant color reproduction. Moreover, the display's capacitive touch functionality is responsive enough to your fingertips that pinching, swiping, and scrolling through Windows 8's tiles quickly feels like second nature. Impressively loud speakers complement the display's eye-candy by pumping out sound at surprisingly high decibels. At maximum volume, the horns and hi-hats on Gold Panda's "Trust" still sounded crisp. Although the bass is somewhat lacking, the speakers are certainly capable of adding some life to the next impromptu party in your dorm-room or office.

Unfortunately, the VivoBook S500CA's chiclet-style keyboard evokes considerably less joy. Despite being accompanied by a generously-sized palmrest, the keyboard's key travel is glaringly shallow even by ultrabook standards and makes typing anything beyond an informal email a fairly uncomfortable endeavor. Moreover, the keyboard isn't backlit, which makes typing in dimly lit settings doubly frustrating. While the VivoBook S500CA's touchpad fares somewhat better and supports Windows 8 gesture controls, its one-piece design occasionally yields somewhat unresponsive left- and right-clicks. Although the touch-screen means this issue isn't a deal-breaker, the inconsistency mars an otherwise decent touchpad.

For the most part, the VivoBook S500CA's port selection is on par with other ultrabooks. The left side of the system sports a multicard reader, two USB 2.0 ports, and a combined mic/headphone jack. The right side sports the system's sole USB 3.0 port, a full-sized HDMI port, a VGA port, and an Ethernet port. While the VivoBook S500CA isn't the only ultrabook to feature just one USB 3.0 port?just look at the Asus S400CA?it's still a bummer for those with multiple peripherals. If this qualifies as a deal-breaker for you, you'd be better off with something featuring two such ports, like the Acer M5-581T-6405.

The VivoBook S500CA comes with a 1TB 5,400rpm HDD for storage and a 24GB SSD that makes booting the system up seem nearly instantaneous. Although its 1TB of storage capacity is generously spacious, the HDD is clogged up with some preloaded software. You'll find all the usual suspects here, like bloatware (links to Skype), trialware (trial versions of Office 2010 and Trend Micro A/V), and a chunk of proprietary software known as the Asus Application Suite. Asus covers the VivoBook S500CA with a one-year warranty on parts and labor, which also includes 24/7 access to tech support and accidental damage coverage.

Performance
Asus VivoBook S500CA-DS51t Like many of the ultrabooks that we've seen, the VivoBook S500CA packs an Intel Core i5-3317U processor and integrated Intel HD Graphics 4000 GPU. That combination, along with 6GB RAM, yields average multimedia and day-to-day performance. This is evident in its Cinebench R11.5 score of 2.39 points, which fell imperceptibly short of both the Vizio 14-inch Thin + Light (CT14-A4) and Asus S400CA (2.40 points each).

A similar pattern emerged in multimedia-oriented tests like our Handbrake video-encoding test, where its performance (1:28) was equal to both the Toshiba U945-S4390 and Vizio CT14-A4 (1:28 each) and only seconds short of the chart-topping Acer M5-581T-6405 (1:25). Likewise, the 5 minutes 30 seconds it took the VivoBook S500CA to run through the dozen or so filters in Photoshop CS6 test was nearly indistinguishable from both the Toshiba U945-S4390 (5:31) and Vizio CT14-A4 (5:29), though it did succeed in blazing past the Asus S400CA (6:28) and Acer M5-481-PT-6644 (7:18).

Asus VivoBook S500CA-DS51t

Although the VivoBook S500CA's integrated graphics demonstrated a moderate capacity for rendering 3D graphics in our 3DMark11 test (1,168 points in Entry-level mode, 210 points in Extreme mode), don't expect to be playing any high-end games here. Like the rest of its class, the 30 frames per second (fps) playability barrier eluded the VivoBook S500CA in both Alien Vs. Predator (scoring 13fps with medium detail, 7fps with high detail) and Heaven (11fps with medium detail, 6fps with high detail).

The VivoBook S500CA's average performance also extends to its non-removable 44Whr battery, which lasted a so-so 4 hours 52 minutes on our battery rundown test. That put it somewhere between the Toshiba U945-S4390 (4:47) and the class-leading Acer M5-581T-6405 (6:17). While it'll get you through a class or two, don't expect to spend an entire day on the VivoBook S500CA without paying a visit to the power outlet.

Despite being a fairly average ultrabook, the Asus VivoBook S500CA-DS51t sports a good touch screen and an affordable price tag. While that's not enough to unseat the Acer Aspire M5-481PT-6644 from its throne as the Editors' Choice for entry-level touch-screen ultrabooks, it's nonetheless a good option for users seeking a well-rounded Windows 8 experience without having to drop too much cash.

The final shot, with windshield wipers struggling to clean away a torrent of muddy water, suggests that no human agency is great enough to handle this world's misery.

"Beyond the Hills" seethes with astonishment and rage at a broken society marooned between the 21st century and the 16th.

It is a haunting movie, dealing with superstitions, possession, even exorcism, one in which Mungiu poses no easy answers, because there are none to be found.

If you long for the bleak intelligence of an Ingmar Bergman film, where humankind is deeply flawed and God is indifferently silent and the landscape is cloaked in perpetual winter, then Beyond the Hills promises to be your cup of despair.

There are no easy villains or heroes in this sad and slow but forcefully told tale, which exhibits the same humanity Mungiu brought to 4 Months, 3 Weeks and 2 Days, his abortion drama that won the 2007 Palme d'Or.

A film that asks its viewer to consider the nature of good and evil, love and trust - and trust that turns into something like blind faith.

When the ill and unstable Alina returns to the monastery, just so she can be with her beloved, Beyond the Hills becomes a species of those exorcism movies that audiences gorge on, only done with a realism and ambiguity usually missing from the genre.

What makes this movie unique is that it holds literally everyone in the film accountable for the unfortunate goings on.

It's an exorcism movie for everyone who thought, after Mungiu's gruelling abortion buddy-movie 4 Months, 3 Weeks and 2 Days, that this guy should do an exorcism movie

It's an enigmatic and austere film from a region where political, sexual and religious repression are as stifling as the sooty air.

Mungui's rigorous approach to filmmaking isn't a ton of fun to watch, but his ideas stick with you.

It delivers an emotional punch, in what its director has called a story about the sin of indifference.

Such is the rigorous and high-minded nature of Romanian cinema that even a real-life exorcism story can inspire something loftier than a horror movie.

Heartbreak at a Romanian convent

...Cristian Mungiu has taken a real life event...to consider deeply human philosophies such as freedom vs. discipline, love vs. security, the choices facing those without financial recourse and the hypocrisies of organized religions.

I found it riveting to watch and fascinating to think about afterwards.

An undeniably tough watch.

Stark, deadpan, and darkly dry.

With this viscerally involving drama, acclaimed Romanian filmmaker Mungiu (4 Months, 3 Weeks and 2 Days) tells another strikingly original story of women caught between old and new world beliefs.

Mungiu is not preaching - he is telling us what can happen when people are trapped within their own emotions and circumstances. Remarkable.

Honolulu court screeners find pet duck in bag

(AP) ? Security screeners at a Honolulu courthouse noticed something moving inside a defendant's bag as it passed through an X-ray machine earlier this week.

After initially refusing to open it, the bag's owner reluctantly revealed that his pet was inside. When he opened the bag, screeners found a live duck and a bottle of beer, Department of Public Safety spokeswoman Toni Schwartz said.

Deputies told Michael Hubbard that his pet and beverage wouldn't be allowed inside Circuit Court, so he left. He returned a short while later and asked that deputies look after his belongings while he went inside for an appointment, Schwartz said, adding that visitors are allowed to leave their things outside at their own risk.

Hubbard went to his appointment, while the duck waited outside. Hawaii News Now reports Hubbard has two felony assault cases pending. He couldn't be reached for comment Thursday.

Schwartz said Hubbard didn't appear intoxicated. "Everything was peaceful," she said.

"We recommend people not bring their pets to court," she said. "Believe it or not this is not an unusual occurrence. A lot of people try to bring their pets to court."

But those pets are usually dogs.

"A duck is unusual," she said. "I don't think we've come across that one before."

Gun control bill clears first hurdle in Senate

WASHINGTON (AP) ? Gun control supporters won the first Senate showdown Thursday over how to respond to the December carnage in Newtown, Conn., defeating an effort by conservatives to derail a package of firearms restrictions before debate could even start.

The 68-31 roll call gave an early burst of momentum to efforts by President Barack Obama and lawmakers to push fresh gun curbs through Congress. The National Rifle Association, along with many Republicans and some moderate Democrats, say the proposals go too far, and the road to congressional approval of major restrictions remains rocky.

The vote came four months after a gunman killed 20 first-graders and six staffers at Sandy Hook Elementary School in Newtown, spurring Obama and legislators to address firearms violence. Congress hasn't approved sweeping gun restrictions since enacting an assault weapons ban 19 years ago, a prohibition that lawmakers failed to renew a decade later.

On Thursday, 50 Democrats, 16 Republicans and 2 independents opposed the conservative effort, while 29 Republicans and 2 Democrats supported it. Gun control supporters needed 60 votes to block the conservatives.

The vote opened the door to begin an emotion-laden debate on the legislation, which would subject more firearms buyers to federal background checks, strengthen laws against illicit gun trafficking and increase school safety aid. Advocates say the measures would make it harder for criminals and the mentally ill to get weapons.

Opponents argue that the restrictions would violate the Constitution's right to bear arms and would be ignored by criminals. Despite their defeat, conservatives were threatening to invoke a procedural rule forcing the Senate to wait 30 hours before it could begin considering amendments.

Early warning signs of population collapse

Apr. 10, 2013 ? Spatial measurements of population density could reveal when threatened natural populations are in danger of crashing.

Many factors -- including climate change, overfishing or loss of food supply -- can push a wild animal population to the brink of collapse. Ecologists have long sought ways to measure the risk of such a collapse, which could help wildlife and fishery managers take steps to protect endangered populations.

Last year, MIT physicists demonstrated that they could measure a population's risk of collapse by monitoring how fast it recovers from small disturbances, such as a food shortage or overcrowding. However, this strategy would likely require many years of data collection -- by which time it could be too late to save the population.

In a paper appearing in the April 10 online edition of Nature, the same research team describes a new way to predict the risk of collapse, based on variations in population density in neighboring regions. Such information is easier to obtain than data on population fluctuations over time, making it potentially more useful, according to the researchers.

"Spatial data are more accessible," says Lei Dai, an MIT graduate student in physics and lead author of the study. "You can get them by satellite images, or you could just go out and do a survey."

Led by Jeff Gore, an assistant professor of physics, Dai and Kirill Korolev, a Pappalardo Postdoctoral Fellow, grew yeast in test tubes and tracked the populations as they approached collapse. Yeast cells cooperate with other members of the population: Each of the organisms secretes an enzyme that breaks down sucrose in the environment into smaller sugars that it can use as a food source. All of the yeast benefit from this process, so a population is most successful when it maintains a certain density -- neither too low nor too high.

In last year's study, the researchers found that in populations of yeast that are subjected to increasingly stressful conditions, populations become less and less resilient to new disturbances until they reach a tipping point at which any small disruption could wipe out a population.

This phenomenon can be spotted quickly in yeast, which produces about 10 new generations per day, but measuring these population fluctuations for species such as fish or deer would take much more time. In hopes of finding more useful signals, the researchers turned their attention to spatial information.

There goes the neighborhood

In their new study, the researchers theorized a new type of indicator that they call "recovery length" -- the spatial counterpart to recovery time. This idea is based on the observation that populations living near the boundary of a less hospitable habitat are affected, because the neighboring habitats are connected by migration. Populations further away from the bad region gradually recover to equilibrium, and the spatial scale of this recovery can reveal a population's susceptibility to collapse, according to the researchers.

To test this idea, the researchers first established several linked yeast populations in a state of equilibrium. At the end of each day, a certain percentage of each population was transferred to adjacent test tubes, representing migration to adjacent regions.

The researchers then introduced a "bad" habitat, where only one in every 2,500 yeast survives from one day to the next. This reduction in population mimics what might happen in a natural population plagued by overfishing, or by a drastic reduction in its food supply.

The MIT team found that populations closest to the bad habitat had the hardest time maintaining an equilibrium state. Populations farther away maintained their equilibrium more easily.

"There's some distance you have to go away from the bad region in order to get recovery of the population density," Gore says. "How far you have to go before you reach equilibrium is the recovery length, and that tells you how close these populations are to collapse."

The recovery length varies based on how much stress the populations are already under.

To apply this finding to a natural population, population density would need to be measured in a range of adjacent areas at increasing distances from a good/bad boundary. This information could then be mapped to reveal the recovery length. "What's great about the recovery length is you don't need a long time series. You could just measure it at one moment in time," Gore says.

The MIT researchers are hoping to expand their studies to natural populations such as honeybees, fisheries or forests. They are also studying more complex experimental ecosystems involving several microbial species.
